This website is operated by Attain Cosmetics. Throughout the site, the terms “we,” “us,” and “our” refer to Attain Cosmetics. By accessing this website, using any part of the site, or purchasing from us, you agree to be bound by these Terms & Conditions, including all policies referenced herein. If you do not agree to these Terms & Conditions, you may not access the website or use our services.
By placing an order through this website, you acknowledge and agree that your submission of an order constitutes an offer to purchase subject to these Terms & Conditions. Your order is not accepted until it has been reviewed and accepted by us.
By checking any “I agree” box, clicking any button indicating acceptance, or otherwise submitting payment for an order, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions, including our policies regarding shipping, returns, refunds, cancellations, chargebacks, and product use.
Online Store Terms
By using this site, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are the age of majority in your state, province, or jurisdiction of residence and have given us your consent to allow any minor dependents to use this site.
You may not use our products or this website for any unlawful or unauthorized purpose, nor may you violate any applicable laws, regulations, or third-party rights in your use of the site or our services. We reserve the right to refuse service to anyone for any reason at any time.
Products & Services
All products are sold for their intended cosmetic use only. We make every effort to display product colors, descriptions, and details as accurately as possible; however, we do not guarantee that your device or monitor will display colors or product appearance accurately.
We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region, or jurisdiction, and to limit quantities offered on a case-by-case basis. We further reserve the right to discontinue any product at any time and to modify product descriptions, pricing, or availability without prior notice.
Order Acceptance & Review
All orders are subject to review and acceptance by us. We reserve the right to refuse, limit, cancel, or hold any order in our sole discretion, including but not limited to orders that appear to be fraudulent, abusive, unauthorized, intended for resale, or otherwise in violation of these Terms & Conditions.
If an order is canceled after payment has been submitted, any applicable refund will be issued to the original payment method unless otherwise required by law.
Order Cancellations
Orders begin processing quickly after placement. For that reason, we cannot guarantee that an order may be changed or canceled once submitted. If you need to request a cancellation, you must contact us immediately at hello@attaincosmetics.com.
If your order has already entered processing or has shipped, it cannot be canceled and will instead be subject to our return policy, if eligible.
Billing & Payment
You agree to provide current, complete, and accurate billing, shipping, and account information for all purchases made through our website. You further agree to promptly update your information, including email address, payment details, and shipping address, so that we may complete your transaction and contact you if necessary.
Charges may appear on your billing statement as ATTAIN COSMETICS or a similar variation. We reserve the right to cancel or refuse any transaction suspected of fraud, unauthorized activity, or violation of these Terms & Conditions.
Shipping Policy
Orders are typically processed within 1 to 3 business days unless otherwise stated. Processing times are estimates only and are not guaranteed. Processing times may vary during launches, promotions, holidays, high-volume periods, severe weather events, carrier interruptions, or other unforeseen circumstances.
Shipping rates and delivery estimates for domestic orders within the United States are calculated at checkout. Delivery estimates are provided by the carrier and are not guaranteed by Attain Cosmetics.
For international orders, customers are solely responsible for all customs duties, import taxes, brokerage fees, VAT, and any other governmental fees or charges imposed by the destination country. We are not responsible for carrier or customs delays.
Customers are solely responsible for ensuring that all shipping information is accurate and complete at checkout. We are not liable for orders shipped to an address provided incorrectly by the customer.
Risk of Loss and Title Transfer: Risk of loss and, where applicable, title to the goods pass to the customer upon our transfer of the order to the shipping carrier. Thereafter, any loss, delay, theft, or damage in transit is the responsibility of the carrier, subject to any rights the customer may have directly against the carrier.
Damaged, Lost, or Stolen Packages
Once an order has been shipped and tendered to the carrier, responsibility for delivery rests with the carrier. If a package is lost, stolen, delayed, misdelivered, or damaged in transit, the customer must contact the shipping carrier directly to initiate a claim or investigation.
We may, at our discretion, provide reasonable assistance in connection with carrier claims; however, we are not responsible for carrier-related delivery failures or losses after shipment.
If tracking shows that a package was delivered but the customer cannot locate it, the matter is considered a carrier issue and must be resolved with the carrier.
Returns & Exchanges
Domestic Returns Within the United States: We accept eligible returns within 14 days of the delivery date. To initiate a return, you must submit a request through your account page within that timeframe.
A return postage fee of $7.50 per package will be deducted from the refund amount. Returned merchandise must be received by us within 30 days of delivery to be eligible for return processing.
To qualify for return, all items must be unopened, unused, untested, unaltered, and returned in their original packaging and original condition. Any item that does not meet these requirements may be refused, partially refunded, returned to sender at the customer’s expense, or discarded without refund, in our sole discretion.
Refunds for eligible domestic returns are issued to the original payment method unless otherwise specified by us or selected by the customer where permitted. Store credit may be issued in circumstances including, but not limited to, nonconforming return conditions, accommodation resolutions, or where store credit is expressly selected or offered.
Original shipping charges and return postage fees are non-refundable. Returns are typically processed within 3 business days after receipt at our facility. Once processed by us, refunds may take up to 10 business days, or longer depending on the customer’s financial institution, to appear on the original form of payment.
International Returns
At this time, we accept international returns for store credit only. We do not offer refunds to the original payment method for international returns.
All international return shipping costs, customs charges, duties, taxes, and any fees assessed upon receipt are the sole responsibility of the customer and may be deducted from the store credit amount issued. We strongly recommend using a fully trackable and insured shipping method for any international return.
Store credit is typically issued within 3 business days after the return has been received and inspected. Store credit may be delivered in the form of a digital gift card or similar store credit instrument.
Non-Returnable Items
Due to the nature of cosmetic products and hygiene considerations, items are only eligible for return if all of the following conditions are met:
- The item is unopened and sealed
- The item has not been used, tested, or altered in any way
- Any shrink-wrap, hygiene seal, tamper seal, or protective packaging remains intact and has not been broken, removed, or tampered with
Products that have been opened, used, tested, altered, or returned in non-pristine condition are not eligible for return.
Exchanges
All exchanges are handled as returns. If you wish to exchange an item, you must submit a return request for the original item, if eligible, and place a new order for the replacement item.
Pre-Orders
If an item is identified as a pre-order item, any stated shipping or fulfillment date is an estimate only and is subject to change without notice. By purchasing a pre-order item, you acknowledge and agree that delays may occur.
If an order contains both pre-order and in-stock items, we reserve the right to hold the order until all items are available for shipment unless otherwise stated by us. Pre-order items are subject to the same return policy once delivered, unless otherwise stated.
Product Use & Education Disclaimer
Our products are intended for external cosmetic use only. By purchasing any product from us, you acknowledge and agree that proper application, curing, maintenance, wear, and removal techniques are required, and that improper use may result in unsatisfactory results, product failure, damage, or adverse reactions.
Results may vary based on individual skill level, technique, nail condition, environmental conditions, lamp compatibility, and other variables beyond our control. We strongly encourage customers to review our available educational materials prior to use.
By purchasing and using our products, you assume full responsibility for their use and application.
Chargebacks & Payment Disputes
We are committed to resolving customer concerns fairly and efficiently. If you experience any issue with your order, you agree to contact us at hello@attaincosmetics.com before initiating a chargeback or payment dispute, so that we may attempt to resolve the matter directly.
Nothing in these Terms & Conditions limits any rights you may have under applicable law or card network rules. However, by placing an order, you acknowledge that we may submit order confirmations, shipment records, delivery confirmation, account history, communications, and any other relevant documentation to the payment processor, card issuer, or dispute platform in response to any chargeback or payment dispute.
We reserve the right to restrict future purchases from customers who engage in repeated, abusive, or fraudulent chargeback activity.
Fraud Prevention
We actively monitor transactions for fraud, abuse, and unauthorized activity. We reserve the right to hold, verify, delay, or cancel any order that we suspect, in our sole discretion, to be fraudulent or unauthorized. We may request additional verification information before fulfilling an order.
Digital Products & Educational Content
Any digital products, downloadable materials, educational content, or similar materials made available by us are licensed for personal, non-commercial use only unless otherwise expressly stated. Such materials may not be reproduced, redistributed, shared, published, sublicensed, or resold without our prior written permission.
User Conduct
You agree not to use the website or its content for any unlawful purpose or in violation of any applicable law, regulation, or third-party right. You further agree not to transmit malicious code, interfere with site security, attempt unauthorized access, scrape or harvest data, impersonate another person, or otherwise misuse the website or services.
We reserve the right to terminate or restrict your access to the site or services for any violation of these Terms & Conditions.

To the fullest extent permitted by applicable law, Attain Cosmetics and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, or inability to use, the website, services, or products, including without limitation damages for lost profits, lost revenue, loss of data, product misuse, improper application, adverse reactions, carrier delays, or delivery issues.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Attain Cosmetics and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms & Conditions, your misuse of the website or products, or your violation of any law or third-party right.
